1) Overview

Welcome to Bitcoin Merch LLC ("we," "us," "our"). By accessing or purchasing from this website (the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

2) Eligibility & Account

By placing an order, you represent that you are legally capable of entering into a binding contract. If you create an account, you are responsible for maintaining the confidentiality of your account credentials.

3) Products & Availability

All products sold by Bitcoin Merch are made to order and produced specifically after you place your order. Slight differences in color, print placement, or appearance may occur due to screen settings and the print-on-demand production process. Damage, manufacturing defects, misprints, and fulfillment errors are handled in accordance with our Refund and Return Policy.

4) Pricing, Taxes & Payment

Prices are listed in USD. Applicable taxes and shipping are calculated at checkout. By submitting an order, you authorize us to charge the provided payment method.

5) Order Acceptance & Cancellation

Your order is an offer to purchase. We may accept or decline orders at our discretion. Once an order has entered the production stage, it cannot be canceled or modified.

6) Fulfillment, Shipping & Delivery

(a) Shipping coverage. We ship only to the 48 contiguous U.S. states and Washington, D.C. We do NOT ship internationally or to Alaska, Hawaii, Puerto Rico, U.S. territories, APO, FPO, DPO, or Armed Forces AA/AE/AP addresses.

(b) Made-to-order production. Once an order enters production, production typically takes 2–5 business days. Production time does NOT include shipping time.

(c) Shipping time. Estimated shipping time after production is approximately 4–8 business days. Total estimated delivery is approximately 6–13 business days. Delivery estimates are not guarantees.

(d) Carriers. We work with trusted carriers including USPS, UPS, FedEx, and regional carriers as needed. We cannot guarantee a specific carrier for any order. Please review our Shipping Policy for complete shipping and delivery information.

(e) Address accuracy. You are responsible for providing a complete and accurate shipping address. If an order cannot be delivered because the customer provided an incorrect, incomplete, or invalid shipping address, the order is not eligible for a refund or free replacement. If the customer wants the item sent again, a new order must be placed and paid for. Please contact support@bitcoinmerch.net if you need assistance before placing the new order.

7) Returns & Refunds

Please review our Refund and Return Policy. Because our products are made to order, ordinary sales are final for change of mind, an incorrect size selected by the customer, or personal preference.

Qualifying claims for damage, manufacturing defects, misprints, or fulfillment errors must be reported within 30 days of delivery. Approved qualifying claims receive a replacement at no additional cost.

Bitcoin Merch does not accept mailed returns. For approved damage, defect, misprint, or fulfillment-error claims, the item does not need to be returned. The registered office does not accept packages or returns.

8) Prohibited Uses

You agree not to use the Site for any unlawful purpose or to infringe upon our intellectual property rights.

9) Intellectual Property

Unless otherwise indicated, original Bitcoin Merch branding, product designs, graphics, and written content created by Bitcoin Merch are owned by or licensed to Bitcoin Merch LLC and are protected by applicable intellectual property laws. Third-party names, trademarks, logos, payment marks, platform assets, and other third-party materials remain the property of their respective owners.

10) Platform & Data Processing

This Site is hosted by Shopify Inc. By using this Site, you acknowledge that Shopify may collect and process your personal data as part of providing its services, including to provide services based on interactions with other merchants and with Shopify. Your data may be shared with third parties located in other countries to provide these services. For more information, please review our Privacy Policy and Shopify's Consumer Privacy Policy.

11) Disclaimer

We do not guarantee that the Site will always be uninterrupted, error-free, or continuously available. Product claims, replacements, and other remedies are handled in accordance with our Refund and Return Policy and applicable law. Nothing in these Terms excludes or limits any consumer right or remedy that cannot lawfully be excluded or limited.

12) Limitation of Liability

To the fullest extent permitted by applicable law, Bitcoin Merch LLC will not be liable for indirect, incidental, special, or consequential damages arising from the use of the Site. Nothing in these Terms excludes or limits liability, rights, or remedies that cannot lawfully be excluded or limited under applicable consumer protection or other law.

13) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, except to the extent that applicable law provides otherwise. Nothing in these Terms deprives consumers of mandatory rights or protections that cannot be waived under applicable law. Any dispute will be resolved in a court or other forum having jurisdiction under applicable law.
